Kansas Fire Investigators Reach Settlement with City Following FLSA Suit

The City of Wichita, Kansas, will pay six fire department arson investigators and their attorney almost $155,000 to settle unpaid overtime claims. The six investigators argued they should receive overtime similar to city police officers as opposed to firefighters. Here is more on those claims.

The Settlement

According to the Wichita Eagle, Wichita’s law department and outside legal counsel “decided the settlement was in the best interest of the fire investigators and the city.” The $155,000 settlement represents 100 percent of the wages the investigators claimed to be owed for the past three years, in addition to an equal amount of liquidated damages, as well as attorney fees for the investigators’ attorney. Each investigator will receive between $17,000 and $30,000 under the settlement. Additionally, the investigators’ attorney, Sean McGivern, will receive approximately $15,000 as part of the settlement.
